Terms of Service
Effective date: March 4, 2026
1. Agreement
By accessing or using the Trace platform, API, SDKs, CLI, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
"Trace", "we", "us", and "our" refer to the operator of traceclick.io. "You" and "Customer" refer to the individual or entity using the Service.
2. Service Description
Trace provides mobile install attribution, deferred deep linking, and related analytics services via an API-first platform. The Service includes:
- REST APIs for attribution, event tracking, and link management
- Cross-platform SDKs for Android and iOS
- A command-line interface (CLI) for app and link management
- Webhook delivery for real-time event notifications
3. Account and API Keys
You are responsible for safeguarding your API keys and for all activity that occurs under your account. You must not share API keys publicly or embed them in client-side code. If you believe your API key has been compromised, rotate it immediately using the CLI (trace apps rotate-key).
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent purposes.
4. Acceptable Use
You agree not to:
- Use the Service to track users without appropriate legal basis or consent as required by applicable law.
- Attempt to reverse the IP hashing process or re-identify anonymized data.
- Generate fraudulent clicks, installs, or events (click injection, device farms, etc.).
- Use the Service to violate any applicable law, including privacy regulations (GDPR, CCPA, etc.).
- Circumvent rate limits, quotas, or other usage restrictions.
- Interfere with or disrupt the Service or its infrastructure.
- Resell, sublicense, or redistribute the Service without written permission.
5. Privacy and Data Processing
Our collection and use of data is described in our Privacy Policy. As a Customer, you act as the data controller for end-user data processed through your app. Trace acts as your data processor.
If you process data of individuals in the European Economic Area, you must sign our Data Processing Agreement before processing begins. You can sign the DPA via the CLI (trace apps dpa --accept).
You are responsible for providing appropriate privacy disclosures to your end users and obtaining any required consent before integrating the Trace SDK.
6. Pricing and Payment
The Service offers Free, Growth, and Scale tiers as described on our Pricing page. Paid subscriptions are billed monthly via Stripe. All fees are non-refundable except where required by law.
We may change pricing with 30 days' notice. Existing subscriptions are honored at their current price until the end of the billing cycle following the notice period.
If you exceed your tier's monthly install limit, attribution pauses but installs continue to be recorded as organic. We will not charge overage fees without your explicit consent.
7. Service Level
We strive for high availability but do not guarantee a specific uptime percentage. The Service is provided on an "as is" basis. We will make commercially reasonable efforts to maintain the Service and notify you of planned maintenance.
The /health endpoint reflects current service status.
8. Data Retention and Deletion
Attribution data is retained according to your pricing tier (7, 90, or 365 days). After the retention window, data is automatically anonymized. You may request full data erasure at any time via the API or CLI.
Upon account termination, we will delete or anonymize all associated data within 30 days, unless retention is required by law.
9. Intellectual Property
Trace retains all rights to the Service, including the API, SDKs, documentation, and website. These Terms do not grant you any rights to our trademarks or branding.
You retain all rights to your app and the data you submit to the Service. We claim no ownership over your data.
10. Limitation of Liability
To the maximum extent permitted by law, Trace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly.
Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold Trace harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
12. Termination
You may stop using the Service at any time. You may cancel paid subscriptions via the CLI (trace apps billing) or by contacting us.
We may suspend or terminate your access if you violate these Terms, fail to pay fees, or if we are required to do so by law. We will provide reasonable notice when possible.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
